Pacific Lutheran football student-athlete Jackson Hale, former Claremont McKenna men’s basketball student-athlete Connor Printz and former Lynchburg dual-sport athlete Chris Jennings have filed a class action lawsuit against the NCAA over the prohibition of athletic scholarships in DIII. From the suit filed in the U.S. District Court for the Central District of California: “The NCAA has engaged in an ongoing conspiracy to fix the price of Division III athletic labor at zero by prohibiting every member of Division III, the NCAA’s largest division at more than 400 schools, from offering a single penny of athletic scholarship. … The Division III prohibition on athletic aid is undeniably a multi-conference agreement in Alston’s own taxonomy. Division III schools remain free to differentiate themselves along every dimension that does not fix the price of the labor that sustains the marquee recruiting tools that are their athletic programs.” (link)
Two amendments-to-amendment have been submitted regarding the age-based eligibility proposal: removing the age of 19 as the starting point for the five-year clock and distinguishing the proposal as division dominant, meaning the proposal would need a two-thirds majority to pass. Of note: “Should a division dominant proposal be adopted by the membership, any future legislative amendments to those bylaws may be submitted only by the Division III Presidents Council.” (link)
Misericordia President Daniel Myers pens an op-ed in Inside Higher Ed opposing the age-based eligibility proposal to be voted on at the 2027 NCAA Convention. Myers points to the conflict between the DIII Philosophy Statement, which notes DIII should “primarily focus on intercollegiate athletics as a four-year undergraduate experience,” and five seasons of competition. Further, Myers cites increased costs for students, unnecessarily extending education that students will not complete, the competitive imbalance between schools with and without graduate programs (Misericordia does offer grad programs) and displacing younger students, with the latter two only exacerbated by transfers between divisions. In conclusion: “Division I’s current difficulties did not arise from one dramatic decision. They emerged through successive accommodations that gradually weakened the connection between athletics and education. … Our task is not to make Division III more like the other divisions. It is to preserve what makes Division III different—and better. Division III has spent decades cultivating a model in which athletics complements education rather than competes with it. At a moment when many observers believe college sports have drifted from their educational mission, Division III should reaffirm what makes it distinctive rather than import policies that erode that distinction.” (link)
Trinity (CT) AD Gavin Viano to the Trinity Tripod’s Clayton Palumbo about the age-based eligibility model. “We don’t have to, and Division III just voted against red-shirting last year, so in a way it feels like we’re basically voting on it again.” (link)
College.town has released a new CollegeSports.jobs report tracking the college athletics job market, and Division III posted the fastest growth of any division, with postings up 39% through September 26 (334 to 464). The hiring base is widening as well, as 126 D3 schools posted jobs (up from 108), including 57 that hadn’t posted during the same months a year ago. Coaching drives the market at roughly three of every four postings, with head coach openings up 38% (112 to 155) and assistant coach openings up 43%. Administrative hiring remains a smaller slice but is climbing quickly, as student-athlete development (27 to 50), communications (20 to 36), development and fundraising (8 to 25) and sports performance (7 to 30) all posted significant gains, and fundraising responsibilities now appear in 44% of D3 job descriptions. New York Yankees President Randy Levine sat down with Tulane Sports Law Director Gabe Feldman on the SportsWise podcast to discuss his role in shaping the Protect College Sports Act. Levine warned that a failure to pass the bill before the end of the year could have far-reaching consequences: “If this bill doesn't go through the House, I don't believe there will ever be a bill that goes through the House. I think this will be the end of it. I think you're going to have universities going bankrupt. I really do believe it. You're going to see Olympic programs and women's programs being shredded and cut." On his ongoing behind-the-scenes lobbying efforts in the House: "Yeah, it's been quiet, but it hasn't been quiet for me and my team. And we've been working this every day, every weekend, every night, trying to make the case. A lot of congressional people are campaigning and a lot of them are uneducated. The more they get educated, more they write like it. ... I'm actually working on a letter to go out to the house as we speak." (link)
Grove City has begun work on around $12M in construction, with the $7M, 50K square-foot air-supported McNulty Athletic Center dome to be cost around $7M and the new Stewart Baseball Field to total $5M. Both projects are slated to be complete in early 2027. (link)
Alverno saw a 75% increase in new student-athletes this academic year, as new student enrollment grew 5%. President Christy Brown says this year’s class is the largest class of new students in a decade. “There were a lot of great athletic stories that I learned about when I arrived here and I want that same sort of experience for the students who are here now. It just became a natural strategy to help grow the college. … I feel as though athletics helps encourage our students to grow their confidence, to grow their discipline, to grow their ability to collaborate with others. I think there is a correlation between leadership and women doing athletics.” (link)

A new study of 5,235 colleges by the Hildreth Institute reveals that institutions in the same geographic markets publish markedly different living-cost estimates, complicating affordability assessments for prospective students, according to Inside Higher Ed's Joshua Bay. Here’s the deal…
➤ The analysis found that approximately half of the evaluated institutions reported allowances for indirect costs were more than 20% above local benchmarks, while higher-tuition and selective colleges frequently estimated miscellaneous expenses well below average rates.
➤ The discrepancies stem from varying institutional methodologies for estimating off-campus housing, food, and transportation, which directly dictate financial aid limits.
➤ Hildreth Institute Managing Director Bahar Akman Imboden emphasized how these inconsistent financial projections directly impact university enrollment and retention: "There is a very legitimate concern there that higher-cost living allowance could make an institution appear less affordable and potentially discourage enrollment. A budget that is too modest can make a college appear more affordable … so a student may enroll, even take out a loan based on this initial picture, only to discover that their actual expenses are beyond their means. If those financial pressures prevent students from completing, then we risk the most troubling kind of outcome of higher education, which is debt without a degree." (link)
