NCAA DIII leadership provided an update on a number of topics following last month’s Presidents and Management Council meetings. Here’s what you need to know…
➤ On the age-based eligibility proposal before the membership at the 2027 NCAA Convention, only the amendment to remove age 19 as a trigger to determine eligibility will be voted on. The proposal for the legislation to be ruled a division-dominant proposal and require a two-thirds majority, as opposed to a simple majority, was, per Managing Director of DIII Jeff Myers: “reviewed by the parliamentarian, ultimately determined to be out of order and inconsistent with the legislative process and will not be considered at the NCAA convention for a vote.”
➤ Myers on the Presidents Council’s signal to recommend referring the age-based eligibility proposal back to the governance structure: “While they continued to discuss the specifics of that referral, the primary piece, as they discussed that and took a look at it, was that they're currently presented with a binary equation in that it's either the status quo or the model that's been endorsed by Division I and II. The question the councils asked themselves is, ‘Have we taken the time and are there other options that may be more appropriate for Division III?’”
➤ The DIII Analysis Working Group is putting together a third case study on membership segmentation. VP of DIII Louise McCleary: “They are working on it not because they believe or they support it, but because they have heard from different segments of the membership, what would happen if the division subdivided or divided? What would be the implications financially for both institutions and the NCAA? How would playing rules work? How would legislation work? How would championships work? And so the working group is going to take that on to make sure, similar to the eligibility and the NIL case studies, that the membership has the full picture ahead of them if they're considering something in that area.” (link)
The U.S. Court of Appeals for the Tenth Circuit has reversed and vacated the nationwide preliminary injunction in the five-for-five eligibility case, Wisne v. NCAA, per Scarlet and Black Insider’s Austin Massey. “The injunction had already been stayed since August 21, and following oral arguments that appeared to go poorly for the plaintiffs, this outcome was largely expected. The three-judge panel concluded that the plaintiffs failed to establish a legally supportable antitrust labor market encompassing all Division I sports. Importantly, the court did NOT decide whether the NCAA's exclusion of the Class of 2022 is ultimately lawful, nor did it address whether NCAA eligibility rules are exempt from antitrust scrutiny.” (link, link - full ruling)
NCAA Chief Legal Officer Scott Bearby’s response to the ruling, in part: “The Tenth Circuit's decision is consistent with the approach taken by every federal court of appeals to consider the merits of preliminary injunctions involving NCAA eligibility rules. The decision also acknowledges the NCAA's concern that retroactively changing eligibility rules can destabilize rosters and disrupt the settled expectations of student-athletes regarding roster spots and playing time. … The NCAA will continue to defend the membership's decision and the rules adopted through the Association's governance process. Although plaintiffs may seek additional review and certain proceedings remain pending before the district court, today's decision vacates the injunction in full and represents another appellate court's recognition that the extraordinary remedy of injunctive relief was unwarranted.” (link)
In response, In The D3FB Huddle’s Frank Rossi: “And this is the death bullet for anyone still thinking the NCAA DIII no-scholarship lawsuit (Printz v. NCAA) has any ability to survive, as the antitrust prong would be the most important requirement for that lawsuit to survive even if a class could be certified. If you can't find antitrust in D1, you're not going to find it in D3.” (link)
The Protect College Sports Act won’t be on the House’s agenda when it returns to session next week, per Yahoo Sports’ Ross Dellenger, who notes the move was expected. (link)
Writing for On3, Dellenger dives into how the Democrats flipping both Congressional chambers impacts the potential passage of the Protect College Sports Act, with New York Yankees President/College Sports Council Vice Chair Randy Levine stating: “The answer is nobody really knows. This was always a bipartisan bill.” More…
➤ With Republicans clinging to a four-seat House majority for the next two months and more than 25 ousted GOP incumbents set to be relocated to makeshift basement cubicles, Capitol Hill aides warn absent lawmakers could sink floor votes across the remaining 20 scheduled working days. Texas Tech Board of Regents Chair Cody Campbell: “The challenge is that a lot of these guys who got booted may not show up to work.” An anonymous House staffer adds: “There’s just no incentive to pass the bill unless Trump can get (House Speaker) Mike Johnson to put it on the floor and have the entire Republican caucus show up as they are getting evicted.”
➤ An anonymous senior Democratic House aide adds: "If you want a quote, here it is: the NIL bill is dead on f****** arrival. They’ve only got to get four Republicans. It’s just a different environment. The Republicans need us now and they want the bill more than we do." Another source suggested to Dellenger that Democrats might want college sports legislation off their proverbial plates before a new Congress arrives, which could pave the way for an attempt to overturn President Trump’s policies around healthcare and tariffs. Campbell adds: “(The election results) make it clear that something has to be done in this lame duck session, so people will finally feel the urgency to stop screwing around and playing games.” (link)
The Athletic’s Stewart Mandel, Ralph Russo and Justin Williams get more comments from key individuals about the legislation…
➤ NCAA SVP of External Affairs Tim Buckley: “Student-athletes from across the country and all three NCAA Divisions worked hard to advance this legislation and thanks to their advocacy, the bill received a massive, bipartisan vote in the Senate. Not acting on the Protect College Sports Act this session would mean not enshrining these transformative student-athlete benefits into federal law, and we will continue to see opportunities for young people to access college sports erode as professionals return to college and steal roster spots from college students. The Association looks forward to working with the House to get this bill across the finish line.”
➤ A Senate Committee on Commerce spokesperson adds: “There is no realistic path to secure the same broad bipartisan support for a new bill in 2027 and beyond. Passing the Senate-approved bipartisan bill through the House and sending it to the President’s desk during the lame duck Congress gives House Republicans an opportunity to close out the 119th Congress with a significant win for President Trump, HBCUs, women’s sports, and student athletes. An attempt to amend it would be a surefire defeat for the colleges and fans counting on PCSA’s enactment.” (link)

➤ Rhodes extends President Jennifer Collins’ contract through June 2031. (link)
The Betty Wold Johnson Foundation is committing an additional $500K to support the expansion of the New York Jets ECAC Women’s Flag Football League from 15 to 2027 members in 2027. ECAC Commissioner Dan Coonan: “This will enable twice as many programs and talented young women to pursue their athletic dreams. The talent and desire have always been there. All they lacked was the opportunity. We are so appreciative of this monumental gift to advance this emerging sport, and can't wait to kick off Year Two of ECAC Women's Flag Football.” (link)
