Democrats won back control of the U.S. Senate and House of Representatives in last night’s midterm elections, securing an estimated 258 seats in the House, well beyond the 218 needed to become the majority party, according to NBC. (link)

Tuesday's midterm elections have reduced the odds the Protect College Sports Act passes during the lame-duck Congressional session to between 5% and 10%, according to Colorado State (DI) FAR/Sacred Cow BBQ publisher Kyle Saunders. More…

➤ Projections showing House Democrats securing at least 258 seats leave incoming leadership with minimal incentive to advance the Senate-passed bill or accept a compromise before January, when incoming committee chairs such as Rep. Frank Pallone (D-NJ), who previously labeled the 2025 SCORE Act “nothing more than a major giveaway” to the NCAA and the conferences, take control of markups.

➤ Outgoing House Speaker Mike Johnson (R-LA) faces internal math challenges given a 218-member majority, compounded by at least 21 House Republicans who formally requested alterations to the bill's 20-member conference cap and House Majority Leader Steve Scalise's (R-LA) push to add an explicit ban on classifying student-athletes as employees. Amending the text would force a return to the Senate, where staff warned the legislation was “a final product” and threatened counter-amendments capping coach, AD and president salaries if conference realignment restrictions were altered.

➤ More Saunders: "When Congress can’t act collectively, the people who need rules tend to write their own, and the courts write the rest. ... So if the bill dies on January 3, college sports absolutely still gets governed in 2027. Conference commissioners, a settlement judge, state courts and a few governors will do it, one rule and one injunction at a time, and the next Congress starts over with House committees led by people who called the last version 'a giveaway.'" More takeaways following last night’s election results…

➤ Speaker Mike Johnson (R-LA) has told staff he won’t run for House GOP leader, per Saunders, who notes “the Speaker who’d have to whip the college sports bill in the lame duck has no leadership future to whip for. And its House sponsor, Michael Baumgartner (R-WA), is in a race too close to call.” (link)

➤ Punchbowl News’ Jake Sherman observes it’s “going to be REALLY hard for House Republican leadership to get people back to Washington for the lame duck.” (link)

The Division 3 job market continues to grow in 2026, according to new data from College.town and CollegeSports.jobs. Through October, D3 job postings rose 7% from the same period in 2025, and nearly all of that growth showed up on CollegeSports.jobs, where D3 listings climbed 22%. Postings on the NCAA Market, by comparison, held essentially flat. Since 2023, CollegeSports.jobs has grown its D3 volume by 123%, while NCAA Market listings have declined 30%. Wartburg VP for Strategic Recruitment/former AD Rick Willis pens an op-ed calling for a more nuanced debate around the age-based eligibility proposal for DIII. Here are some of the notable takeaways…

➤ Willis acknowledges the concerns around competitive balance and the student experience, but sees the contradictory pressures of expanded eligibility and institutions pushing for three-year degrees to lower education costs and poses the question to institutional leaders: “Can Division III institutions afford to make decisions based solely on tradition and philosophy if those decisions have meaningful enrollment and financial implications? Financial sustainability is a necessary part of the conversation.”

➤ “The real question is whether our policies reflect the realities of today while staying true to the educational mission that has always distinguished Division III. I suspect thoughtful Division III leaders will continue to disagree on this issue. … Whether Division III ultimately adopts or rejects a five-year model, the decision should be driven by a thoughtful assessment of its impact on students, institutions, and competitive equity. Questions of affordability, educational value, enrollment sustainability, and institutional mission all deserve a place in the discussion.”

➤ “Whatever decision is ultimately made, it needs to be implemented thoughtfully. There may be value in slowing down enough to fully consider both the intended and unintended consequences before making a permanent change. What I hope we avoid is reducing the conversation to slogans about preserving tradition or resisting change. The issue deserves a more thoughtful discussion than that. Division III has always been at its best when it balances the needs of students, the realities facing institutions, and the educational values that define the division. As this debate continues, that balance should remain our guiding principle.” (link)

Related, the NAIA has approved the five seasons of eligibility proposal starting in 2027-28. The rule allows a fifth year of eligibility to student-athletes who have completed 96 semester or 144 quarter credit hours, with at least 64 semester or 96 quarter hours towards general education of a student’s major. Notable: “Under the NAIA’s new model, the expiration of the NCAA’s five-year clock will not automatically exclude a transfer student’s eligibility. Depending on a student-athlete’s previous participation and enrollment, they may have eligibility remaining in the NAIA.” (link, link - full legislation)

With Maryville moving back to the CCS in 2027-28, the Scots will remain affiliate members of the SAA in football, softball and women’s golf. (link)

House settlement plaintiffs attorneys are petitioning a federal court to approve $18.6M in fees and expenses after logging more than 3,430 hours monitoring and enforcing the settlement during its first year, per Sportico’s Daniel Libit. The request filed by Hagens Berman and Winston Taylor asked U.S. Magistrate Judge Nathanael Cousins to award them $3.81M for “monitoring and enforcement” work, $14.82M in incentive fees tied to the student-athlete revenue-sharing pool and just over $200K in related out-of-pocket expenses. Under the settlement, attorneys Jeffrey Kessler and Steve Berman may seek annual payments of up to 1.25% of the amount of money schools spend on athlete revenue-sharing. “In their latest petition, however, the attorneys are ultimately seeking a lower rate of 0.75%. Kessler and Berman also noted they are not seeking compensation for nearly $2.73M in additional billable work they performed over the past year. That work included addressing pending appeals of the final settlement approval and ‘responding to an enormous volume of inquiries’ from class members regarding sale of their claims to third-party claims purchasers.” All funds, including backpay damages to class members, remain in escrow until the Ninth Circuit Court of Appeals rejects challenges to the settlement. SUNY New Paltz is projecting an $8.8M deficit for FY27, with $7.8M in cash balances as of the end of FY26. Further, projections show the reserves dipping to -$3.5M in FY28 before bouncing back positive by FY30. VP for Fiscal Strategy & Management Gregory Reed on the limited options for controlling costs: “SUNY sets the price. Campus doesn’t control our labor rates, so that’s been negotiated elsewhere. The money we earn at the campus can’t be pooled and used to cover where we have expenses that are outpacing our revenues.” The five-point plan for the university to improve its financial position: “increasing investment in enrollment growth, improving campus wide efficiency, expanding non-tuition based revenue, managing expenses and establishing methods of monitoring and accountability to ensure progression in the university’s goals.” (link)
