The U.S. Court of Appeals for the 10th Circuit appears poised to reverse a nationwide injunction that would grant a fifth year of eligibility to the high school class of 2022, a potential major legal victory for the NCAA, Sportico's Michael McCann observes. During oral arguments in the Wisne case yesterday, McCann notes NCAA attorney Rakesh Kilaru successfully pressed the argument that the plaintiffs' antitrust claims lacked sufficient market data, warning that allowing the return of former players would actively drive down athlete wages through labor oversupply while displacing current roster members. Conversely, players' attorney Robert Shelquist argued the NCAA operates as an unfair monopolist but faced a "hot bench" that repeatedly criticized his broad definition of the relevant antitrust market encompassing all DI athletes. A victory for the NCAA would only cover the 10th Circuit’s jurisdiction of Colorado, Kansas, New Mexico, Oklahoma, Utah and Wyoming. Notably, the Moore case is in a wait-and-see position given the overlap with this case. (link)
Meanwhile, Ohio Gov. Mike DeWine (R) issued an executive order Tuesday stating that “no state institution of higher education or private college or university in Ohio shall uphold any rule, requirement, standard or other limitation that prevents a student-athlete of that institution or college in the Class of 2022 from fully participating in intercollegiate athletics in the 2026-27 academic year, regardless of whether the student-athlete completed four seasons of intercollegiate competition or exhausted eligibility under 2025-26 NCAA regulations or any prior regulations, and regardless of any athletic authority's interpretation of applicable NCAA eligibility bylaws.” (link) More…
➤ The Ohio Supreme Court has ordered briefing on the impact of Gov. Mike DeWine's executive order on the Borovicanin v. NCAA five-for-five eligibility case. Boise State Assoc. Professor Sam Ehrlich adds: “In the meantime, it has stayed the decision of the Ohio Court of Appeals -- restoring the lower court's injunction and making those players eligible.” (link)
➤ NCAA President Charlie Baker indicated in a statement that “the Governor of Ohio cannot legislate NCAA eligibility rules. One elected official seeking to make their own rules for their own schools' advantage is a terrible way to run athletic competitions and precisely why Congress must pass the PCSA as soon as possible. … Eligibility rules established through the Association's governance process have been and will continue to be applied consistently across the membership by the NCAA including in the state of Ohio.” (link)
Extra Points’ Matt Brown put together an expense comparison for over 100 public DII schools from FY25 MFRS data, with Grand Valley State leading the cohort with a $26M in operating expenses and College of Staten Island rounding out the group at $2.24M. For leagues with at least four schools reporting data, the GLIAC had the highest median at $14M, followed by the GNAC, MIAA, PSAC and CCAA. Overall, the median athletic department expense was MSU Denver at $8.53M, with the 10th percentile spend totaling $15.3M. Looking at ticket sales revenue, the top five were all schools with DI hockey programs. Brown: “If we remove the D-I hockey programs, the top D-II programs are generating in the $300,000 to $800,000 range for total ticket sales, primarily from football.” (link)
Morehouse AD Harold Ellis sat down with College.town’s Kristen Eargle to discuss the Maroon Tigers’ roadmap for success and more. Here are some of his notable comments…
➤ On completing his five-year plan in three years: “Whenever you get to a new job, you have all these big plans, accomplishments, which you're trying to bring to the school, trying to have your vision. And I had a five-year plan and got there in three. It's been a ride. It was tough the first year learning the whole campus, learning the people, learning the league. And then the second year got better. And the third year, we just took off. It was incredible. … What really helped me this year, we have a new president, Dr. Bowman. He was excellent. He's a sports president. So that's what really helped. And I think it's the leadership and winning starts at the top.”
➤ On expanding Morehouse's athletic brand through scheduling: “In three years, we have the Southeast. I want to make us national, nationwide. I want to grow our brand athletically. So it's like scheduling better football games, traveling with the basketball team. We're actually going international this year for the first time in history to the Bahamas to play a football game. That'd be great for the student-athletes. So I want to take the brand to another level athletically.” (link)
A video of a Winston-Salem State staff member painting yard markers on the field at Bowman Gray Stadium went viral this week. AD Eric Burns tells HBCU Gameday’s Steven J. Gaither the Rams have hired an outside company to handle painting the field moving forward. Burns’ official statement: “The field markings at our last home game fell short of WSSU athletics’ standards, and I take responsibility. We’ve secured additional field preparation support and implemented new checks to ensure this is addressed before our next home game. Our student-athletes and Ram Nation deserve the highest standard, and we are committed to meeting it every time.” (link, link)
MSU Moorhead will move its football and soccer finales off campus. Football’s regular-season finale against Minnesota State to be held at North Dakota State’s (DI) Fargodome and soccer’s finale against Minnesota Crookston will take place at the Fargo Parks Sports Center. AD Chad Markuson: “With the Red River Roadshow, having football at the Fargodome and soccer at the Fargo Parks Sports Center, we’re taking the Dragon game-day experience beyond campus. We want to create memorable moments for our student-athletes and supporters.” (link)
DII donated over $270K to Make-A-Wish during the 2025-26 academic year, with $221K coming from member schools and conferences and $51K coming from DII championships and enforcement fine allocation. (link)
Tusculum is the latest to add women’s flag football starting in 2027-28. (link)
Goldey-Beacom promotes Women’s Soccer HC Heather Faasse to Asst. AD/SWA and Lightning Baseball HC Tom Riley will serve as Women’s Basketball Interim HC as GBC replaces Bethann Burke, who is headed to SUNY Maritime (DIII) as its new AD. (link, link)
The Minnesota State Board of Trustees is weighing a proposal to reallocate up to $25M per year over the next four years to financially challenged institutions, with St. Cloud State and Bemidji State to receive $10M and $4.8M, respectively. That funding would come from a change in how institutions contribute to the system’s emergency fund, with the MinnPost reporting “two-year colleges would contribute about three times as much money as four-year universities.” (link)
The National College Attainment Network’s annual Affordability Gap survey found that just 32% of 542 public bachelor’s-granting institutions were affordable in 2023-24, the most recent year with complete data, with the average affordability gap totaling $1,801. The gap grew larger than previous years, despite FY24 including a $500 increase to the maximum Pell Grant award. Notable: “In 2023-24, food prices remained high following a spike in 2022, and housing prices, especially rent, also continued to rise. During that academic year, living expenses made up a larger share of the cost of attendance than tuition and fees, on average. Because NCAN’s model accounts for the full cost of attendance, these trends are accounted for in the analysis. … NCAN’s analysis of Pell funding suggests that if the maximum award had been indexed to inflation since the 2023-24 academic year, it would be about $8,100 today.” Across the country, 12 states did not have a single public B.A.-granting school where aid, family contribution and earnings covered the cost of attendance and in just 10 states, the average school was financially within reach for students. Full report. (link)
