The Tennessee Court of Appeals has issued an order staying the injunction granted to the plaintiff athletes in the Jalen Washington v. NCAA case, per Boise State professor Sam Ehrlich, who notes: “As with Ohio, those players are now ineligible unless and until the Court of Appeals rules in their favor.” (link)

Following the ruling, NCAA Chief Legal Officer Scott Bearby issued a memo to members that reads, in part: “We are encouraged that each of the three appellate courts to consider these injunctions has recognized the strength of the NCAA's legal arguments and the significant harm caused when ineligible student-athletes are permitted to compete. The decisions reaffirm the importance of preserving a level playing field for the thousands of student-athletes and member schools across Division I that are competing under the membership's rules. Consistent with our approach following the appellate decisions in Wisne and Borovicanin, we will notify courts across the country considering similar requests for injunctive relief of this important development. The Association will separately continue to defend challenges brought by former student-athletes seeking additional eligibility and continue to pursue expedited appellate review of any injunctions that may be entered. The NCAA stands by the membership's eligibility rules and will continue to vigorously defend those decisions in courts across the country.” (link)

Northeastern State President Rodney Hanley and AD John Sisemore join the RiverHawks SportsNest to dive into a number of topics. On the change to the age-based eligibility model, Sisemore notes only six NSU student-athletes will be impacted by the change, adding: “It's adapt or die, and that's my philosophy. You can complain about what's happening or you can figure out how to play the game. And so you can complain about the game that's going on today and spend your time spinning your wheels and not figuring it out or figure out how to play the game. And so what we're going to do every day is we're going to give attention to what's handed to us and we're going to figure out how to play the game.” Hanley notes he and Sisemore have been intentional about growing enrollment through athletics, with the addition of men’s and women’s wrestling bringing 93 new student-atheltes to campus. Columbus State becomes the second DII department with a jersey patch partner, with YMCA of Metropolitan Columbus to sponsor the Cougars’ men’s basketball jerseys. AD Justin Hay: “We are incredibly excited to partner with the YMCA of Metropolitan Columbus in a way that represents much more than a logo. The YMCA shares our commitment to developing people, strengthening our community, and using athletics as a vehicle to make a positive impact. Public outcry over the issue of pro athletes attempting to return to college sports is reportedly providing a boost to efforts to pass the Protect College Sports Act, per Semafor’s Burgess Everett. NCAA SVP for External Affairs Tim Buckley said the “outrage” over the topic has “really changed some minds on Capitol Hill about the need for this legislation” and could help shore up support. “The events over the past week have been helpful to help us drive home the point. You don’t need to take our word for it or the conference’s word for it. This piece of legislation gives senators the ability to fix this problem for their constituents.” With Senators having pushed back the legislation’s consideration until September, Everett posits the delay might just improve the bill’s fortunes by helping it accrue 60 votes as the pro player controversy builds. Buckley adds: “The polls are really clear about this and you don’t need to be a political genius to understand it is wildly unpopular … to use college sports as a fallback.” (link) 

Puck's John Ourand reports that the PCSA currently has enough votes to pass the Senate, though House action remains unlikely before the November elections. Proponents argue the standoff provides the necessary leverage to finally establish a unified national framework with antitrust protection, with one lobbyist who supports the PCSA telling Ourand: "This has galvanized the SEC, and even the Big Ten, to pass a bill, as imperfect as it might be." Another lobbyist who supports the bill adds: “Lawyers are now lining up to sue the SEC instead of the NCAA. I mean, it’s just a mess. Everybody should want some acceptable guidelines and guardrails on what you can and can’t do. Let’s just have one rule that’s enforceable and has liability protection from the federal government.” (link)

Three DII football teams knocked off DI opponents as week 0 kicked off last night. Ohio Dominican beat Morehead State (DI) in a triple overtime thriller. Concord earned its first win over a DI opponent, defeating Davidson (DI). South Dakota Mines knocked off Drake (DI) with a 38-35 win. (link)

Keystone Sports and other international college athlete placement agencies face growing obstacles as federal visa restrictions and tighter roster limits threaten their business models, according to Sportico's Daniel Libit. The subsidiary of Oslo-based Keystone Education Group charges foreign athletes up to $10K to navigate the U.S. collegiate pipeline, an avenue disrupted by a 10% drop in international student applications and the NCAA's five-year eligibility mandate. The industry is also dealing with the Department of Homeland Security's four-year cap on F-1 student visas, which forced Keystone Sports executive Gonzalo Corrales to scramble for emergency embassy appointments for 350 clients in July. University of Kentucky assistant professor Simran Kaur Sethi notes these pressures incentivize firms to misrepresent the college sports landscape to prospective families: "Some of them are really telling parents that there isn’t any issue on college campuses, so your son or daughter is going to be fine, because universities are their own bubble. Living in America, we know that isn’t true—but agencies don’t live in America. However, they’ve got to keep their business going." (link)

Bluefield State’s Board of Governors reversed its decision this summer to extend President Darrin Martin’s contract, thus “ending his employment with the university.” This comes as the board did not get notified of “potentially serious violations of NCAA rules,” the university being “significantly behind” on paying at least $1.5M, an inability to get reliable evidence about outstanding debts or institutional finances and more. Board Chair Charlie Cole: “The Board’s immediate priorities are to stabilize the University’s financial position and protect the future of the institution for its students, staff, faculty, and community. We are taking swift steps to strengthen financial oversight and meet the University’s obligations responsibly.” (link)
