#10: The Ohio First District Court of Appeals has reversed the judgment of the trial court's preliminary injunction in the Borovicanin v. NCAA five-for-five eligibility case and the Kentucky Court of Appeals has dissolved the injunction allowing class of 2022 student-athletes to compete. Boise State Assoc. Professor Sam Ehrlich: “Notably, the appellate court is not disturbing the [Ohio] trial court's finding that athletes are intended third-party beneficiaries of the NCAA bylaws (though it's not affirmatively saying they are). That's a critical threshold issue, and a key ‘Can this be revisited?’ question for me. … While the opinion is mostly on procedural issues, the [Kentucky] court does joins Ohio from this morning in rejecting the idea that the plain text of the new eligibility rule bylaw allows Class of 2022 athletes eligibility, albeit for somewhat different (though more forceful) reasons.” (link, link, link)
#9: Kansas State AD Gene Taylor confirmed to The Mercury that the department will take out a traditional bank loan to pay former Men’s Basketball HC Jerome Tang the $12M termination settlement the two parties agreed to. Per his contract, Tang was owed $18.7M. Taylor noted that “if we had to come up with that out of cash, it would’ve hurt us,” and added that asking donors to cover the buyout was not ideal “because of everything else we’re asking from them.” (link, link)

#4: The DI Cabinet has approved a proposal that would move men's soccer to a two-semester playing season. Because it passed with less than 75% of the vote, the proposal will now move to a 30-day rescission period, during which eligible DI schools or conferences can submit a vote to defeat the new rule. If two-thirds of the eligible members do not vote to defeat it, it will subsequently take effect. (link)
#3: North Dakota State collaborated with Under Armour and Athletics Admin to create a custom, one-game collector’s edition uniform worn for the Battle of the Basins Trophy match-up against Wyoming, per Mountain West Connection’s Mike Wittman. Preceding and during the game, the jerseys were auctioned to fans, with proceeds supporting NDSU Athletics’ "Climb the Mountain" campaign and the continued transition into the Mountain West.
